Why Bankruptcy May Be the Answer

However, bankruptcy offers homeowners a solution to stopping the foreclosure and catching up on the back mortgage payments. The bankruptcy code gives homeowners the right to take up to 5 years to systematically pay back the arrears using their disposable income. At the conclusion of the repayment plan (normally 3-5 years) the homeowner is caught up and their other unsecured debt is discharged. Additionally, banks often will approve mortgage modifications in bankruptcy when they denied them earlier. And, after reestablishing a payment history (usually at least 1 year) in the bankruptcy repayment plan, you will be more likely to refinance your mortgage and cure all the back payments immediately.
If you have a second mortgage on the home, under the right circumstances (2nd lien completely underwater) the lien can be “stripped” and the debt considered unsecured. The result is that at the end of the bankruptcy case the second mortgage (often the home equity line of credit) is considered paid off and the lien discharged.
To take advantage of the bankruptcy option a homeowner facing foreclosure must file the bankruptcy case before the sheriff sale.
